AVERSA, ETAL, v CITY OF NEW YORK, ETAL.

FACTS: Pregnant New York City Correction Officers were told to have abortions or lose their jobs. A federal lawsuit was initiated under Title VII, State Human Rights Law and the Administrative Code of the City of New York for pregnancy discrimination. Several of the women had abortions, several women were forced to quit their positions and several women were terminated. In total 21 women were victims of the discriminatory conduct.

RESULT: An exhaustive settlement agreement was entered into which restored all women to their former positions, back pay was awarded, seniority and other non-economic issues were put in place, emotional distress compensation was awarded and training and other remedial and preventive policies were put into effect. Total value of the settlement was estimated at approximately Three Million Dollars.
